1. Acceptance of the Terms
By accessing or using the AppMaromba application ("App"), you agree to comply with and accept the terms and conditions described in this document ("Terms of Use"). If you do not agree with these Terms of Use, do not use the App.
2. Service Description
AppMaromba is a fitness challenge and championship app where users can create and take part in challenges based on how often they go to the gym. The goal is to encourage physical activity, allowing participants to win virtual medals or cash prizes, depending on the type of challenge. The App also offers additional features for workout tracking, activity logging and social media interaction.
3. Main Features
- Fitness Challenges and Championships: The app lets users create and join gym attendance challenges. There are free challenges, awarding virtual medals (gold, silver and bronze), and paid challenges, where winners can receive cash prizes after the PIX payment is confirmed.
- Workout Setup and Logging: Users can set up their workouts, including the exercises in each session. The app also lets them log workouts at the gym in real time, marking exercises as "done" as they are completed.
- Maromba Camera: The App offers a "Maromba Camera" with custom filters so users can take photos of their progress and share them to their gallery or directly to social media.
- Social Media Integration: Users can share challenge results on social media, with direct integration to Facebook and Instagram stories.
4. Creating Challenges
When creating a challenge, the creator must define the following mandatory information:
- Challenge start date and end date
- Challenge rules and notes
- Challenge type (regular or cash prize)
- Price (paid challenges only)
- What happens in case of a tie: extending the challenge by 1 day or splitting the prize
5. Challenge Start and Cancellation Conditions
- Free (Regular) Challenges: Can be cancelled by the creator only before the challenge starts. They expire and are automatically cancelled if they do not have at least 2 participants on the start date.
- Paid Challenges: Cannot be cancelled once the entry has been made. They do not expire. If the challenge does not have at least 2 participants on the start date, it is automatically postponed, adding 1 day to both the start date and the end date. The challenge keeps being postponed until it has at least 2 participants.
6. User Data
To create or join paid challenges, users must provide certain personal information, including:
- Full name
- Mobile phone number
- Tax ID (CPF)
- Address
This data is collected exclusively for issuing invoices and verifying participation in the challenge. We ensure the security and privacy of this information, as described in our Privacy Policy.
7. How Check-in Works
To record their presence at the gym, users must use the App's check-in feature, which uses geographic location (latitude and longitude) and the Google Places API to verify that the user really is at a registered gym.
8. YouTube Videos in Workouts
To help with exercise execution, the workouts feature may display demonstration videos. To find them, AppMaromba uses YouTube API Services. Regarding these videos, we clarify that:
- The videos are not authored by AppMaromba. We do not produce them, we do not host them and we do not edit them.
- They are search results obtained from the YouTube Data API, returned based on the exercise name, and they belong to their respective channels and authors, who hold all rights to that content.
- AppMaromba does not review, endorse or guarantee the accuracy, safety or suitability of the videos displayed. Performing any exercise is the user's own responsibility, and users should seek guidance from a fitness professional whenever necessary.
- Videos may be changed, become unavailable or be removed at any time by their authors or by YouTube itself, without prior notice and without AppMaromba having any control over it.
- Playback happens in the official YouTube player. You may not download, copy, redistribute or modify these videos, in accordance with the YouTube Terms of Service.
- By using this feature, you also agree to the YouTube Terms of Service and the Google Privacy Policy. The data processed by this feature is described in section 4 of our Privacy Policy.
- If you hold the rights to a video that is displayed and want it to stop appearing in the App, please contact us at [email protected].
9. Participation Rules
- Users are responsible for ensuring that the information provided in the app is true, complete and up to date.
- Use of the App is personal and non-transferable. Users may not assign their account to third parties.
- Participants must ensure that the gym check-in is performed honestly and accurately.
- Any attempt at fraud, manipulation or misuse of the App may result in the deletion of the user's account and loss of prizes.
10. Payments and Refunds
- To join a paid challenge, users must pay the amount set by the challenge creator via PIX.
- Paid challenges cannot be cancelled after entry.
- In case of withdrawal or cancellation of the challenge before it starts, the amount paid cannot be refunded.
11. Limitation of Liability
AppMaromba is not liable for technical problems or communication failures that may affect check-ins or participation in a challenge. In addition, the app is not liable for the accuracy of the information provided by the user.
12. Intellectual Property
All rights to the content, design, code and features of the App belong to AppMaromba and are protected by copyright and intellectual property laws. Users are not authorized to copy, modify or distribute any part of the App without the express permission of AppMaromba. This clause does not apply to third-party content displayed in the App, such as the videos described in section 8, whose rights remain with their respective holders.
13. Changes to the Terms
AppMaromba reserves the right to modify or update these Terms of Use at any time. Users will be notified of the changes and must agree to the new terms in order to keep using the App.
14. Privacy Policy
The collection and use of users' personal data is governed by our Privacy Policy. By using the App, users consent to the collection, use and storage of their data as described in the Privacy Policy.
15. Final Provisions
- This agreement is governed by the laws of Brazil, regardless of any conflict of law principles.
